Terms of Service

These Terms of Service ("Terms") govern your use of Junk Hauling CRM, a product of TJM Consulting ("Company," "we," "us," or "our") ("Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Junk Hauling CRM is a B2B SaaS platform designed to help junk hauling and demolition businesses manage their operations, including customer contacts, job scheduling, estimates, and invoices.

2. Eligibility

You must be at least 18 years old and operating a legitimate junk hauling, demolition, or similar business to use this Service. By using the Service, you represent that you meet these requirements.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at timmarose@gmail.com.

4. Subscription and Billing

Pricing and Plans

The Service is offered on a subscription basis with tiered plans: Free, Starter, and Growth. Current pricing and features are available on our pricing page.

Billing Process

Subscriptions are billed monthly in advance. Payment is processed through Stripe, our payment processor. You authorize us to charge your payment method for the subscription fee.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Price Changes

We reserve the right to change pricing with 30 days advance notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable federal, state, or local laws or regulations
• Send unsolicited SMS messages to contacts who have not opted in
• Harass, threaten, or defraud any person
• Collect or store personal data in violation of applicable privacy laws
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any purpose other than managing your legitimate business

6. SMS Communications

By enabling SMS features, you agree to:

• Only send messages to contacts who have provided express written consent
• Comply with the Telephone Consumer Protection Act (TCPA) and all applicable telecommunications regulations
• Maintain records of consent for all contacts you message
• Include opt-out instructions in all SMS communications
• Not use the platform to send unsolicited commercial messages

You are solely responsible for compliance with TCPA and applicable laws. TJM Consulting is not liable for your misuse of SMS features.

7. Data Ownership

You retain full ownership of all data you enter into the Service, including customer contacts, jobs, estimates, and invoices. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing the Service.

8. Intellectual Property

All software, design, content, and technology underlying the Service is owned by TJM Consulting and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Confidentiality

We will keep your business data confidential and will not share it with third parties except as described in our Privacy Policy or as required by law.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to access the Service ceases immediately. We will retain your data for 90 days following termination before permanent deletion.

11. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, TJM Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including lost profits or data loss, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the three months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless TJM Consulting and their officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Maryland.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
